Equity is not found in the constitution. The constitution does not guarantee equality of outcomes. At best it tries to set up equal opportunity, but even that is impossible because success is usually mostly about ability. The problem with this is that it doesn't actually account for you know... frequency of crimes. What's the ideal per capita population of prisoners? Surely it would depend on well offending rates. Social justice is largely gibberish. Justice that is not individualized isn't justice, it's merely asking to implement explicit [racial/sexual/etc] discrimination.
The primary example for that I keep on hand for criminal social justice is this:
There are certainly improvements we can make in our system, but cherry-picked statistics without any actual discussion is not particularly useful. Most of these social justice claims are at best far more nuanced when investigated or proven to be outright nonsense. A couple examples:
- A stat that I've heard a few times (but admittedly not verified) is that women of color are 4 times more likely to be sexually assaulted than white women (insert some snide remark about clutching pearls).
- Then, the abolish the police/ abolish prison folks advocate not enforcing laws, including laws regarding violent crimes for "racial justice" purposes. So we are not protecting black & Latina women, but also refuse to prosecute black & Latino perpetrators for "racial justice" purposes.
- This isn't just some right-wing claptrap. The city of Baltimore released a list of crimes that the would reduce enforcement of because the accused were not proportional to the races of the population, including, you guessed it, rape & sexual assault.
- Racial bias in education: Since the mid 90s racial discrimination has at most a couple percent of the average difference between racial groups. Socioeconomic status and hours spent studying outside the classroom explain almost the entirety of the difference in average performance of racial groups with just those two factors accounted for.
- In terms of income and establishing oneself in this country. There are bigger financial gaps within "broad" ethnic groups than between ethnic groups. Recent immigrants from Ghana, Nigeria, and the Caribbean are doing quite well in America. We can wave our hands away with "immigrant pluck" comments, but the plain and simple truth is that pluck is a dedicated pressure from family to succeed in this life. (Why is broad in quotes? I mean, what the heck is an Asian? Chinese, Indians, Laotians, North Koreans, South Koreans, Japanese, Burmese, and Malaysians are all the same?)
