    NRA-ILA :: National Parks to Allow Right-to-Carry

    National Parks to Allow Right-to-Carry

    Friday, December 05, 2008

Fairfax, Va. - The U.S. Department of the Interior (DOI), through the National Park Service and U.S. Fish and Wildlife Service, has announced the final amended version of its changes to rules on carrying of firearms in national parks and wildlife refuges. DOI’s move will restore the rights of law-abiding gun owners who wish to transport and carry firearms for lawful purposes on most DOI lands, and will make federal law consistent with the state law in which these public lands are located. The National Rifle Association (NRA) led the effort to amend the existing policy regarding the carrying and transportation of firearms on these federal lands.
“Today’s announcement by the U.S. Department of the Interior brings clarity and uniformity for law-abiding gun owners visiting our national parks,” said Chris W. Cox, NRA chief lobbyist. “We are pleased that the Interior Department recognizes the right of law-abiding citizens to protect themselves and their families while enjoying America's National Parks and wildlife refuges.”
DOI announced the rule change today and will publish the new regulations in the Federal Register. The new regulations allow right-to-carry permit holders to exercise their Second Amendment rights on national park and wildlife refuges in those states that recognize such permits. The move will provide consistency across our nation’s federal lands and put an end to the patchwork of regulations that governed different lands managed by different federal agencies. In the past, Bureau of Land Management and Forest Service lands allowed the carrying of firearms, while lands managed by DOI did not.
The NRA has long held that amendments to those regulations were needed to reflect the changed legal situations with respect to state laws on carrying firearms. Earlier this year, fifty-one U.S. Senators sent a strong bipartisan letter to the DOI supporting the move to make state firearms laws applicable to national park lands and refuges.
“These changes respect the Second Amendment rights of honest citizens as they enjoy our public lands,” concluded Cox. “We applaud the Interior Department’s efforts to amend these out of date regulations.”

    Good news!

This raises two questions in my mind:

    1. Does anyone think this will set a precedent with other Federal agencies and administrations? I ask because of the Indiana DNR properties that are controlled by the US Army Corp of Engineers, which are the only places the change in DNR regulations disallowed our right to carry.

    2. How long before Obama's administration reverses this, and makes it worse than it was before?

Well, we can at least enjoy just over 40 days of the right to self defense in National Parks.

DO **NOT** CARRY IN NATIONAL PARKS OR NATIONAL WILDLIFE REFUGES YET!

The new ruling will take effect 30 days AFTER it appears in the Federal Register next week. So, I would say it will be effective no later than January 12th!

Can we carry in INDIANA STATE PARKS or is that illegal?

I believe some have signs forbidding guns in the parks.

    ???

Indiana State Parks have been legal since September 2006. The signs you saw are either old leftovers, or are on Federal or Army Corps of Engineers-managed lands.

I just visited Mesa Verde National Park, and while they wouldn't let you carry, they did not make you check your firearms at the door. This is what their rules say:

"Firearms are prohibited. They must be broken down or otherwise packed while in the park."

Not the best situation, but better than most.

Up until today's ruling, that was the only way. It was legal to have a firearm in your possession, but only broken down and out of easy access. The new ruling allows you to carry a loaded gun on your person just like you were a real human being with the Right to self-defense.

    As it should be.

The previous rule wasn't the best, but was better than having to leave it at home.

    Well yes, sort of.

Governor Daniels approved a 1 year temporary rule that allowed people with a License to Carry to carry in the State Parks . . . however, I have no idea if that is still in effect. In theory, that ruling could have been retracted as of Sept 22, 2007 when it automatically expired unless it was renewed or unless the Natural Resources Commission approved it. I have not heard that it was renewed. I have not heard that the Natural Resources Commission has approved it.

So does anyone know the CURRENT status? Has it been formally adopted by the NRC or has Governor Daniels formally renewed his order each year since 2006?

Thats great news for a couple of days anyways.

Being in Smokey Mt. National park where bears have been known to chase or/and attack hikers this makes me feel more comfortable hiking in the park. In fact in Aug. my fiance's parents were confronted and chased by a bear (yes they know not to run from a bear but there is only so close people are willing to let a pissed off bear get to them). This came right after a boy and his dad were attacked by bear killing the boy. So some protection never hurts. However, I don't think I would have enough fire power to stop a bear so getting away would still probably be the best choice.

Wonder how long it will be until someone tries to protect themselves from a bear and PETA/Liberal jump all over that? But if they are able to stop a bear from attacking them this will be a good thing for gun rights.

Yes, it was made permanent and it also encompasses I-DNR property as already noted.

Great news. I must admit I'm shocked that it went through. I'm glad the change was made before the Obama administration takes over.

It's a damn insult to me that one of these Mountys think they have rights to protect themselves and not I. The arrogance of Govt. employees astounds me.
