New BATF ruling on stabilizing braces today

    So this is just my opion snd I'm sure there probably others....
    This is in regards to those pistols in the classifieds. If you have until may to register these items, then are you breaking the law selling with a brace on the pistol? I say no, but most all i have seen are selling the ar "pistol" without the brace for the same price if it had the brace.
    The straight up question is..should they still be sold with or without the brace up till may when they have to be registered??

    Most folk I have spoken with are erring on the side of caution and taking the approach that selling a pistol with brace is an NFA violation. I have formerly braced pistol in the classifieds for slightly less than the original asking price and am offering the brace free to the buyer in a separate transaction, conforming to all NFA crap.

I have formerly braced pistol in the classifieds for slightly less than the original asking price and am offering the brace free to the buyer in a separate transaction, conforming to all NFA crap.

    As I recall the braces by themselves are OK because its not illegal until you put them on the gun. The retailers are still selling them, but the most cautious are requiring the brace to be a totally different transaction from the pistol.

    Here is hoping this all becomes a moot point shortly.

    Yeah, I did a quick search in the classifieds and there’s at least one new-ish one in there.

    Fellas, if your ad gets deleted, it’s because of this policy. Nothing personal, just re-list it without the brace being included in the ad or the transaction.

    What is you own an AR pistol and you also happen to have a brace within 6 feet of the pistol. That is less than social distancing so I suspect the would AFT frown upon that.
    What if the brace is 20 feet away in the next room?
    What if the brace is 50 feet away, would they still shoot your dog?

    Any idea when we will see updates on the pending litigation?
    See #973, #977 and #979 in this thread. They have links to the current status of all six lawsuits currently in various District Courts in several states (Texas, North Dakota and Florida). Those links will take you to the "Court Listener" docket for each . . . and the minute records will give you current status. The legal wheels turn slowly, and DoJ with BATFE will stall any adjudication as much as they can. There is one on a fast track for some action due in the third week of March, just over a month from now. DoJ and BATFE were NOT happy about that.

    At this point in the game if a brace is illegal why would people use them. If a person wants to pay a huge fine and spend some time in the federal lockup wouldn't they just use a rifle stock instead? Same time and fine for the crime?

    At this point in time I have a couple braces but I do not have any stocks. That could influence my choice if I were to use something.

    We are within a grace period, you can keep playing with your brace until (I believe) May 1, then you either need to either take it off or have applied for your stamp.

    The rule is vague how it applies to people who buy a brace during the grace period (its almost as if the ATF failed to consider that the braces are universal and can be bought separately and attached to any existing pistol) but I they would likely have to prove you didn't already own the brace when the rule was published to make any charge stick.

    As for stocks, there is no grace period so that is an immediate crime.

    There is no way to prove when you acquired a brace, because braces are not serialized, and are extremely common. I think they would have to prove that you bought a pistol or a pistol lower after the announcement of the rule, and then attached a brace to it.
