When they delegate authority for determining what the law is and not merely the enforcement thereof, yes, this is a breach of constitutional authority. I would make the same argument in delegating the authority to coin money and regulate the value thereof to the Federal Reserve. I would make the same argument for delegating to the Executive Branch, hence the ATF to make up its own damned gun laws withing very broad limitations. The purpose of the Congress is to make laws, not write the President/appointees/bureaucrats blank checks to make up their own.
