    Apparently the story title was changed after the gunfreezone article was published. It now reads "LSU football players threatened in robbery shoot and kill 18-year-old suspect".

    They probably had a BUNCH of people call them out on it.
    They probably weren't prepared for that.

    Lauren McCluskey, the 21-year-old Utah track athlete who was abducted outside her Salt Lake City dorm and killed in October, had called both University of Utah police and Salt Lake City police multiple times to report her attacker’s harassment before her death, according to 911 calls obtained by CNN.



    And yet.. people think WE are crazy for wanting to have tools to increase our chances of defending ourselves.

    Chicago, New Year's Eve, via Second City Cop (SCC).:

    Around 9:40 p.m. in the 2900 block of West Cortland Street, two male suspects with handguns got out of a silver Nissan and told the man they were robbing him, police said. The man, who is a concealed carry license and firearm owner’s identification card holder, shot both suspects, police said. They were taken to local hospitals and stabilized.

    A few posts down from the above article SCC has a post on something on of his readers passed on. This person had a 4 yo daughter in Children Lurie Hospital for appendix surgery. A friend who is a uniformed Chicago Police officer stopped by to offer support -- and the hospital would not let the officer - in his uniform - in unless he checked his gun with security. No guns for cops unless they are on a official business. SCC notes the hospital has no metal detectors and no armed security.

    LSU head coach Ed Orgeron said Thursday night that the players "are two of the best young men on our football team. We believe in Clyde and Jared and we support them totally."
    They were cleared to participate in the Fiesta Bowl and traveled with the team, but I don't know if they actually played or not.

    WICHITA, Kan. (KSNW) - The Wichita Police Department arrested a 17-year-old boy in connection with two armed robberies. They are still looking for two suspects.

    The robberies both happened Friday. The first occurred at the Family Dollar Store in the 900 block of South Woodlawn. The second happened at the B & H Fast Trip in the 2700 block of South Seneca.


    A little more detail on the robbery from Actaeon's link:
    At approximately 2:45 p.m., officers responded to a shooting at the B & H Fast Trip. They found a 16-year-old boy with a gunshot wound. He died at the hospital. Police said the 16-year-old boy and three others entered the store, pointed guns at and employee and customers, and demanded money. The suspects took money and cigarettes. During the robbery, 42-year-old man, a customer, pulled out his gun and fired multiple shots toward the suspects. One struck the 16-year-old boy. The other three suspects fled.

    I don't think I covered this one earlier:

    Suspected San Antonio thief killed while stealing car jack identified

    Just before 0630, mechanic finds guy stealing jack out from under a car parked in front of mechanic's house. The mechanic grabbed onto the thief's car as he tried to drive away, and the mechanic fired a couple shots. It is not known (at least by the press) if the thief was even hit by the bullets, if he was hit did he die from gunshot wound, or from trauma of the ensuing crash.


    Also:
    Police said it's likely the homeowner, described as a man in his 40s, would not face charges. He added that the homeowner works as a mechanic and he uses his tools as a way to make a living.


    This nearly the exact scenario that came up in my very first CHL class back in 1998. The instructor for the class brought in the felony prosecutor from the Bexar County DA's office to lecture on deadly force laws. He said each morning he reviewed all the felony arrests from the previous day and decided which to pursue. We asked him about using deadly force to protect property in the night time -- what did he envision as a justifiable scenario?

    Texas law on defense of property reads in part:

    A person is justified in using deadly force against another to protect land or tangible, movable property:
    1) ...

    2) when and to the degree he reasonably believes the deadly force is immediately necessary:
    (A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or
    (B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and
    (3) he reasonably believes that:
    (A) the land or property cannot be protected or recovered by any other means; or

    The prosecutor would not go so far to say "this particular scenario is OK," but he did say (my paraphrasing) that if a pay-check to pay-check carpenter who made his living with his tools and would not be able to pay his rent, feed his family etc if his tools were stolen, it would be a major factor in his decision.


    ETA: "nighttime" is defined in the Texas Transportation Code as from 30 minutes after sunset to 30 minutes before sunrise. On the day of this event, sunrise was at 0718.
