    New Jersey politicians are hard at work making sure this is the only way a righteous citizen can get a gun to defend himself:
    The intruder allegedly arrived at the residence brandishing a semi-automatic handgun and a fight erupted with the man who lives at the home.

    Police say that during the altercation the resident was able to get control of the gun and fired — hitting 29-year-old Terrence Coulanges, of Old Bridge, who died later at an area trauma center.
    The two were acquainted, so there might be more to this, but as reported, sounds like good job on the part of the resident.

    Redundancy is all legislators do.

    No duty to retreat, covers anywhere you are any time.

    The same with the law to defend yourself against LEO unlawfully entering. The case should have been vacated by the courts because the original judge was wrong in his opinion.

    Sheesh! Lawyers!

    They "why" of a person's presence at a location doesn't matter much. (Heck, even criminals doing crime have a right to self defense at a certain level.)

    It will matter if the person had a reasonable fear of death or serious bodily injury.

    I guess the "new" castle doctrine stuff (I still think of it as new) might come into play, but mostly it'll be an assessment of self defense, IMHO.

    Criminals have a right to self defense?

    I unfortunately knew a few of the suspects involved. The 2 surviving suspects have been charged with the death of the 3rd burglar. I've heard of similar things in other cases but that seems crazy.

    They were all heroin addicts as well, really sad what this drug does to our communities. Breaking into people's homes is horrible but it's still really sad that a man is dead, also horrible that innocent people had their property violated and were forced to protect it. He was actually not a bad person but that drug changes people, it takes over and starts making your decisions for you.

    Well, the commenters didn't seem to think it was "unfair".
    (yes, I know you were talking about other times where families of the perp said that)

    Most of the commenters on the Houston Chronicle (and other Texas newspapers) stories about burglars getting shot have a distinct lack of sympathy for the burglars. When it is it reasonably clear of the guy was a thief, commenters don’t much care if he was shot going to, in the commission of, or running from a burglary.
