    San Antonio:

    Police arrested a 19-year-old man in connection with a violent gun battle at an East Side gas station that left another teenager with a gunshot wound to the back of the head.

    The suspect, Javonta Kenneth Marquise-Whitfield, is now facing a charges of marijuana possession and unlawful carrying of a weapon. He remains in the Bexar County Jail.

    According to a preliminary report of the shootout, Marquise-Whitfield and a 17-year-old boy entered the 7-Eleven in the 5200 block of Rigsby Avenue just after 2 a.m.

    The gas station clerk later told police Marquise-Whitfield shot at him, and he returned fire, striking the 17-year-old boy in the back of the head.

    How the shooting was initiated was not addressed in the preliminary police report, and Jennifer Rodriguez, a spokeswoman for the department, said no other information regarding the shooting would be released.

    The 17 yo is in stable condition at San Antonio Military Medical Center (BAMC for us oldster locals).

    Houston:

    A customer who just left a check cashing store in the Northline area fatally shot a man who tried to rob him, Houston police said.

    The customer, Richard A. Smith, and his fiancee were leaving the business in the 100 block of Little York, near Airline, about 1:10 p.m. Wednesday when a man approached them and demanded money, police said. The man concealed his hands in a threatening manner, police said.

    Smith fired his handgun and fatally struck the man, who was pronounced dead at the scene.


    But...

    Smith, 27, has been charged with being a felon in possession of a firearm. He was previously convicted of felony robbery in Warren County, Miss. , according to court records.

    This begs the question, when someone pays their "debt to society" are they never allowed to defend themselves again?

    Should there be recourse to regain your civil rights?

    In many states there are pushes to renew voting rights of felons.

    Is the right to vote more important than the right to self defense?

    Cliff's notes: 21 yo woman organized a burglary of using two 18yo and 15yo males as the burglars while she (and possibly someone else) drove the getaway car. They had already burglarized a garage apartment at the same address when they returned to burgle the house itself. The house was occupied by a 23 yo man who upon hearing a glass door being broken armed himself with an AR15. He confronted three individuals wearing black clothing, masks, and gloves, bearing brass knuckles and a knife. He shot them, two collapsed in the house, one ran out and collapsed outside (it is apparent from the 911 recording that the 23 yo did not realize he hit the third one). The young man then barricaded in a bedroom and called 911. The third link has a recording of his 911 call. In the fourth link above it seems to say each burglar was hit with a single round.

    The prosecutor and sheriff both agree the young man legally defended himself. The female getaway driver turned herself in and was charged with both burglary and three counts of first degree murder. She doesn't believe she's responsible for the teens death. In other articles she says she doesn't blame the young man for defending his home, but in other thinks the young man should have only shot them in the legs. hmmm.

    STATE OF OKLAHOMA vs. RODRIGUEZ, ELIZABETH MARIE

    It appears she pleaded guilty to three counts of 2nd degree murder for which she was sentenced to serve 32 years for each. Also admitted some burglary charges, and owes $1300 in court costs.

    Pretty much textbook home defense. With an AR15.

    Gramps is actually making the case that when his idiot grandprogeny, bearing weapons, break into people's houses, people should stop and ascertain what the idiots' intentions and weaponry are before taking action. I can sympathize with the grief of families who lose a family member, especially a child, for any reason (especially a stupid bad one). But when they try to weaponize their grief to blame others for the immoral and criminal actions of their kin...no sympathy whatsoever. That's abusing society's compassion.

    An update on this:

    Police identify man killed in confrontation with clerk over photos at Walgreens, police say


    Hurley had pulled a gun during a confrontation with the employee about the photographs, according to police.

    ...

    The interaction between Hurley and the clerk, who was not identified, escalated when the clerk attempted to verify the man was the owner of the photographs.

    The clerk backed away and attempted to call 911 as Hurley allegedly retreated with the photographs. Hurley was allegedly threatening to kill the clerk around that time, and then allegedly returned to the counter in an effort to cross over it again.


    "The clerk then pulled his own gun and shot the deceased multiple times," Watkins said.

    No arrests had been made Wednesday in connection to the triple shooting.



    Two other people — a customer and an employee — were struck by gunfire. The two bystanders were behind Hurley, Tulsa Police Sgt. Brandon Watkins said.


    Clerk acted in self-defense, will not be charged. Walgreens says he is "no longer with the company."

    Man blasts suspected trailer thief with shotgun on SW Side, San Antonio police say
    The man caught the three suspects, men in their 20s, stealing his trailer at about 4:10 a.m. in the 5400 block of Painted Horse Street.

    He followed the suspected thieves for a few blocks before confronting them. The suspects and trailer owner exchanged gunfire, and one of the suspects was struck by a shotgun blast. The other suspects fled.

    Paramedics took the suspect to University Hospital for treatment.

    The owner of the trailer is not expected to face criminal charges in the shooting.

    Palmetto City Commission back to work following recent self defense shooting involving commissioner

    This happened last month, but just found the article noting the commissioner's first public meeting since the incident:

    Williams was home with his daughter on Riverside Drive. He opened fire on Avelino Vasquez-Perez after the suspect forced his way into Williams' garage, attempting to break into his home. Two bullets struck Vasquez-Perez and he was then captured by police.
    "The circumstances of this particular incident were pretty cut and dry and allowed for a pretty quick conclusion about whether the use of force was justified," said Chief Scott Tyler with the Palmetto Police Department. "And we believe the commissioner was defending his home and his family.”

    Witnesses at the scene reported that two men were arguing outside of a business where a child’s birthday party was being held. While in the parking lot, one of the men was armed with a knife and made threats to get a handgun from his vehicle.


    After making threats he allegedly discharged his firearm at the second man who in returned fire resulting in a fatal injury. After the shooting, the uninjured man called 911 and immediately surrendered to law enforcement when officers arrived on scene. ...


    After interviewing several witnesses the shooting is now considered an act of self-defense by police and no charges will be filed.

    ETA:

    It appears the deceased party, who was 30 at time of death, was charged with three counts of robbery and nine counts of kidnapping as part of a robbery gang when he was 19.

    The article says the home owner "arranged for someone to be in the house...".

    I know it is legal for you to protect your own property, but does this situation bring up any legal challenges for the shooter? What about the other guy inside with him?
    I'm guessing they were not members of an armed security service per se, at least that wasn't reported.
    Would that make a difference, being paid as security?

    They "why" of a person's presence at a location doesn't matter much. (Heck, even criminals doing crime have a right to self defense at a certain level.)

    It will matter if the person had a reasonable fear of death or serious bodily injury.

    I guess the "new" castle doctrine stuff (I still think of it as new) might come into play, but mostly it'll be an assessment of self defense, IMHO.

    I thought we had no duty to retreat. Supreme court 18??.
