This will be an interesting lawsuit. I'd like to see it kick down the whole ID requirement for exercising a Right. Not sure why the gentleman didn't go with a private sale, where no ID would be required (except by anal retentive sellers). This one may well have to work its way all the way up to the SCOTUS, considering that the BATFU is involved and they have deep pockets and no will to make life easier on gun owners.

Hmmm. I saw this story awhile ago but figured since I'd been out most of the day, it'd been posted already. Oh well.

The feds will not be detered. They'll just come out with thumb print readers or some other means to keep their common sense gun measures, already on the books, alive.

So in theory, we should not need an ID to exercise a right? ;)

Biometrics still wouldn't work for the amish. They engrave an image and store it. This will be an all or nothing, imo. I'd be glad to go back to the days when you didn't have to show an ID to exercise a Right. I didn't show an ID when I bought my first firearm. No background check or anything. We don't need that crap.

Oh come on, does anyone really think the current make up of the court won't say you have to have ID to exercise 2A right but not voting rights?

We live in a post-constitutional era. Whatever they can get away with they will.

I'm not saying I agree with having to do it only that they'll figure out another method that passes the "engraven image test". Way too many folks, including lots of gun folks, have pointed to the existing pre-purchase checks as important safeguards for the public against criminals being able to buy guns.

Don't you need an ID for a job, benefits, and other areas where fraud would be high or to confirm your identity?

Yet, none of those are rights protected in the Constitution.

First, these are not points where the Amish are affected anyway. In fact, there separate status largely rests on the fact that they do not participate in the system.

Second, and most important, none of those are protected rights, but then again, the Constitution grants the federal government no authority whatsoever to impose itself here, therefore it should not be. Please remember that it wasn't until after FD Roosevelt packed the Supreme Court that it was 'discovered' that the interstate commerce clause granted the federal government authority over everything even if it never left the farm where it was grown.
