    A privilege is only valid if the courts agree it exists, and applies to a particular case.

    If a person were seeking information that the government had mined, that's one thing. But to call into question the program itself would not, I would argue, invoke the privilege.

    The government's statement begs the question whether the suits actually trigger any such privilege...

    Next question, should such a privilege be recognized, or abrogated.

    Yes, this is a very clever way for the government to deal with this issue. Let's see what the NY Times thinks about this Nixonian turn of events...
