Apologies for the long post in advance. Names withheld to protect the innocent and as to not start unfounded rumors.
Anyone ever had this happen? Looking for advice (lawyers on here please feel free to chime in).
I want a very specific firearm, was unable to find locally or anyone local who could obtain and ordered a brand new pistol online. The dealer has good online reviews and the firearm was shipped promptly the Monday after I ordered (8/2/21) and was a very fair price (free shipping, no CC fee). Received notice and tracking info from the common carrier and was excited earlier today to see it had arrived at my local FFL.
About 1.5 hours later my FFL called, I answered quickly anticipating I could pick it up, field strip, clean and oil and get it to the range this weekend (or sooner). Unfortunately I was informed that the box looked partially damaged with tape on one end and when opened there was no pistol, just some water bottles!
So now the tricky part. Who is responsible for either replacing my firearm or reimbursing me?
Full disclosure I have contacted the selling and receiving dealers, my FFL says to contact the seller which I have but no answer (left voicemail) and emailed.
My local FFL signed for and accepted the package.
My understanding is I have no standing with the common carrier although my name may have been listed on the address. Do I file a claim with them?
Last resort would be to dispute the charge on my CC but will give everyone time to respond before resorting to that.
Also, this is not a terribly common pistol and not that may available and the price has gone up $65 since I started looking ($35 since I ordered).
