In a 9 - 0 victory for Jack Daniels the Supreme Court ruled that a dog toy "Bad Spaniels" is NOT protected by the 1st amendment as it infringed on the trademark design and logo of Jack Daniels. JD can now proceed with its trademark infringement case.

In the future this should put a leash on companies trying to ride the coat tails of already established company trademarks, for good or ill.

US Supreme Court's dog toy ruling puts parody products on notice
The U.S. Supreme Court handed brand owners a win against parody products on Thursday when it ruled that "Bad Spaniels" dog toys resembling Jack Daniel's whiskey bottles are not shielded by the U.S. Constitution from the liquor maker's trademark lawsuit.
