More movement on the Mock v. Garland case in the District Court

For reference: Mock v. Garland in Northern District of Texas, before Judge Reed O'Connor with Mock being supported by FPC.
    https://www.courtlistener.com/docket/66774568/mock-v-garland/

ATF filed a reply brief yesterday (Feb 7th) regarding their Dec 18th cross-motion for summary judgement (in their favor) opposing the FPC's Nov 14th motion for summary judgement. Typical tactic. Bury the plaintiffs motion for summary judgement with a cross-motion a month later and make all about that one. Anyway . . . this is the brief ATF filed. The sequence:
    • Dec 18th: ATF cross-motion
    • Jan 17th FPC response (re their motion and cross-motion)
    • Feb 7th this ATF reply to FPC's response yesterday:

    Happy reading . . .

I've not been through it yet. Expect some remarks by various guntubers in the next day or so.

Video titles always leave me hanging
The Britto nationwide injunction is the weakest one. The others that enjoin enforcement against organization as four organizations are named plaintiffs and theirs are much stronger (GOA, 2AF aka SAF, FPC and NAGR). ATF once again is playing games . . . throwing pasta on the kitchen wall to see what sticks. They're claiming every member of every organization covered by an injunction must personally travel to the court with attorney in hand to petition it to be added as a plaintiff. Ridiculous to expect millions of individuals to make such motions. It would be utter chaos. They're making other ridiculous claims as well, demanding comprehensive organization member lists (SCOTUS has already ruled long ago that such demands are unconstitutional). Those are some of the major highlights.

I realize the rancorous ire some have that feel it's a "Pay to Play" to have to pay dues to join an organization to be covered by a preliminary injunction, and that it should be blanket one nationally (which Britto did). However, preliminary injunctions are normally issued to cover named plaintiffs. I expect the injunctions protecting organization members to stand as that's already been heard by the Fifth Circuit before regarding one organization that had a domino effect for the other in their cases. I wouldn't bet on the Britto case blanket nationwide preliminary injunction withstanding ATF's challenge.

Fifth Circuit hasn't ruled on ATF's motion and it will continue to percolate at Fifth Circuit for a while. The Plaintiffs in all of the cases must have an opportunity to respond. The wheels turn slowly.

Speaking on braces, i thought you all would like to see this. The left really does remind me of the Nazi Party, this being like calling up the Gestapo to find a way to kill or ruin your life over differing political ideology.

They think 'Democracy' is only for those that agree with the hive mind.

In other words.. they DON'T believe in Democracy.
It's just a word to them.
Everyone also forgets though that the country is a constitutional republic and not a democracy.

In my opinion, believing that we are a democracy is why libs think its ok to violate the constitution on rights not just related to the 2nd or why we hear certain people in the political spectrum wailing for the electoral college to be done away with or allowing non citizens to vote on elections related to u.s affairs.

Forgetting the fact that we are indeed a country based off a constitution with written guidelines on how the nation is to function with rights granted to it's people and not mob rule is why we see what is going on now in society.

I actually think you're on to something here...but if you replaced 'forgetting' with 'ignoring,' you might be even closer. Libs in general tend to never let inconvenient facts sway them from their opinions, so they just plain ignore those facts as if they don't exist. Maybe 'willfully forgetting'??

We can't forget on INGO....every time someone says democracy someone reminds us all its a representative or republic....

Except that one guy that just reminds us we have to abolish the central state because the democracy or republic died 150ish years ago or so.
