    . May go out about 7:00 am tomorrow :): since its near his property line and fire up that diesel engine (no muffler) and scoop up several dozen more buckets of clay and expand the berm. Oh, did I mention that I live in a private neighborhood with a Home Owners Association? Yup, you guessed it, the HOA allows shooting :ar15: A brand new neighborhood newsletter was mailed out about a week ago, it reminded everyone that shooting is allowed in the neighborhood. :yesway:

    I live in a rural area in Hendricks County. I shoot a lot. I had some city dwellers move in near me a few years ago. They don't like me shooting. They called my chief and my insurance company. Neither one helped them out. It really ticked me off. By the way,I only have three acres but I have a berm. I despise people like that,

    Around here the fireworks have been going off as early as 7:00am and as late as 2am. Why in the heck is your neighbor complaining about a little gun fire at 9:00am? Some of those firecrackers are a lot louder than gun shots. Just sayin'.

    Since this is the "use" and not the "ownership, possession, sale, transfer, or transportation of firearms", this may not help, but there's a couple of shiny new amendments that took effect three days ago:

    IC 35-47-11
    Chapter 11. Local Regulation of Firearms
    IC 35-47-11-1
    Applicability of chapter
    Sec. 1. (a) This chapter applies to all units (as defined in IC 36-1-2-23).
    (b) This chapter does not affect the validity of an ordinance adopted before, and in effect on, January 1, 1994.
    As added by P.L.140-1994, SEC.13. Amended by P.L.90-2010, SEC.8.

    IC 35-47-11-2
    Regulation of firearms by units other than townships
    Sec. 2. Notwithstanding IC 36-1-3, a unit may not regulate in any manner the ownership, possession, sale, transfer, or transportation of firearms (as defined in IC 35-47-1-5) or ammunition except as follows:
    (1) This chapter does not apply to land, buildings, or other real property owned or administered by a unit, except highways (as defined in IC 8-23-1-23) or public highways (as defined in IC 8-2.1-17-14).
    (2) Notwithstanding the limitation in this section, a unit may use the unit's planning and zoning powers under IC 36-7-4 to prohibit the sale of firearms within two hundred (200) feet of a school by a person having a business that did not sell firearms within two hundred (200) feet of a school before April 1, 1994.

    I do believe that your neighbor is "feces out of fortune", fortune being a synonym for luck, and I applaud your efforts to make peace with him via the use of your front-end loader.

    Perhaps it's the rapid pace of firing your neighbor objects to. If you wish to try to keep the peace, in the interests of being a good neighbor, perhaps you should do your early morning shooting with a bolt action so the gunshots aren't coming so close together.

    A Mosin-Nagant may give him the peace and quiet he is seeking, while still allowing you to shoot. :D

    I live in a housing area just east of Eagle Creek Range (across I-465). When I worked for Emergency Management, we attended some public meetings complaining about the police firing at the range. Seems a guy managed to buy a house in the housing area without realizing that the range was there. Kinda surprising to me since I knew it was there before I bought my house and IPD/MCSD were training there almost every day, including most weekends. This guy DEMANDED the City stop inconveniencing him and scaring his children; he wanted the range shut down. What he GOT was a commitment to stop shooting at 2230 (although I continued to hear firing as late as 2330 occasionally). My boss, who is an attorney as well as being the Emergency Management Director at the time, very politely (I thought) didn't tell him to go pound sand.

    I did go up to him after the meeting and ask for the name of the realtor who sold him the house. I wanted to know in case I ever wanted to sell mine - and also so I would know never to buy anything from that person...He didn't laugh; I don't know why...

    If the cops do show up talk to them let them know what your neighbor has said and how you've tried to address his concerns. Invite them to come out and shoot with you (don't know how you feel about that, and that your not in violation of any ordnances) a lot of cops appreciate being able to go somewhere and shoot where there's not a lot of people that's going to bother them with a bunch of questions or whine about getting a ticket on a traffic stop. It can't hurt that the cops know you're a good guy and perhaps your neighbor will come over and complain while their shooting.
    Also, I'd tell the neighbor to stay off my property and send him a certified letter stating such.

    The HOA has NO RULES regarding noise from guns, it simply allows that shooting is a legitimate use of the land. Each year the HOA sends out at least 1 newsletter reminding residents (and informing the new residents) that shooting is permitted.

    What rules does it have about noise in general. Shooting noise is still noise regardless of source.

    I'm a few counties east of you, but heres what happened to us in St. Joe county.

    We were shooting at a buddies house,(safe backstop) DNR officer who lives about 1 mile away showed up (we all went to school with him). Said he got a report from the county of "machine gun fire" and excesive noise.
    He looked at our backstop said it was good to go and would report to county that any calls about us shooting would be explained to the caller about us being checked.
    He told us that the best thing to do would be talk to the neighbors about their concerns and if there were certain times they would like us not to shoot. havent had any problems since

    Last evening about 6pm we had the local sergeant and tactical training officer pay us a visit.

    OH, he brought his family, drank beer, ate food, watched fireworks, watched a movie, played with my dogs, and stayed until almost 1am.

    Did I mention when I told him the story he LAUGHED about my neighbor and told me to keep on shooting as I pleased?!?

    While he is not an LEO over the jurisdiction of which I reside, that would be county, he is an officer in the town adjacent to us and said there is NO WAY that my neighbor has any sort of legitimate complaint. He may not like the noise? He may not like guns? He may not like me? And yes he may call the sheriff and complain, but he has no LEGITIMATE complaint against us or any of our other shooting neighbors.

    I will still try to make reasonable adjustments like not shooting before 10am, and I did get a good bit of a new berm built up behind my target area in front of the base of the hill. But I will still shoot as is my right, as I have done on this land for 20 years, as is legal and safe. And if the sheriff does show up then I will invite him to visit my shooting area and perhaps pop off a few rounds with me.

    That would be awesome if he took you up on that offer.

    I have also wondered about Lake County Ordinances relating to shooting on ones property. I also live in Unincorporated Lake County, and feel like with the right berm, I could safely target shoot. I've spent tons of time on the internet with no clear answers.
