Utah restricts non-resident CCW permits

    Apparently, the Governor of Utah signed a bill last week that:

    requires a nonresident applicant for a concealed firearm permit to hold a current concealed firearm or concealed weapon permit from the applicant's state of residency that recognizes the validity of the Utah permit in that state or has reciprocity with the Utah concealed firearm permit law;

    I learned about this on another forum and actually didn't believe it at first. I was sort of amazed that there hasn't been an uproar over it. It doesn't effect us in Indiana, but I know a number of people who live in restrictive may issue states, and in states that do not honor the Utah permit that will no longer qualify for a Utah non-resident permit.

    I wonder if they will grandfather in current holders??

    My little brother resides in the Socialist State of Illinois but has a current Utah card.

    It looks like he is good until his renewal if I undertand it correctly. For new applicants, it starts May 10, 2011, BUt for renewals, it starts Jan 1, 2012.

    I used to have a FL permit, but it expired before I remembered to renew it. Of course, I still have my IN LTCH. Is the Utah one easier to get? Does it cover more states?

    Utah is only $65 and is good for 5 years. Renewal is $10, although I think it is raising to $15. Florida is $117 for 7 years with another $117 to renew. That makes Utah cheaper in the long term. Utah gives you all of the states that Florida does with the exceptions of Kansas and New Mexico. Utah also adds Minnesota. The only downside to Utah is that they require a class for the initial license. If you add Arizona to Utah you get every state that you would get with a Florida plus Minnesota and it is still cheaper long term. That's what I did.

    Interesting. I had hear that some states were going to stop recognizing UT since it was too "easy" to get. I wonder if this is UT's response. "Fine, don't accept ours? Then we won't let your residents get ours." tit for tat.

    It is a bit annoying to out of staters, but it seems fair from a UT perspective. I guess if you are in a state that does not qualify, it might be time to petition your legislature to accept the UT permit in reciprocity.

    I'm assuming that they qualify :)

    But we (IN) do not have CONCEALED permits and per the text you quoted it sounds like UT will only accept CONCEALED permits so we might be screwed. :dunno:

    SInce the LTCH permits us to conceal carry if that is our choice, and is in fact Indiana's version of what other states call a "concealed permit," and since Indiana recognizes Utah permits, I am certain we'll be fine. They don't care what we call it or if it also permits us to openly carry,

    Here's the appropriate text of the statute:


    74 (4) (a) In addition to meeting the other qualifications for the issuance of a concealed
    75 firearm permit under this section, a nonresident applicant who resides in a state that recognizes
    76 the validity of the Utah permit or has reciprocity with Utah's concealed firearm permit law
    77 shall:
    78 (i) hold a current concealed firearm or concealed weapon permit issued by the
    79 appropriate permitting authority of the nonresident applicant's state of residency
    ; and
    80 (ii) submit a photocopy or electronic copy of the nonresident applicant's current
    81 concealed firearm or concealed weapon permit referred to in Subsection (4)(a)(i).

    The way this is worded leads me to believe that you only have to have a home state permit if your state recognizes the validity of, or has reciprocity with the Utah permit. If you live in a no-reciprocity state or a no-permit state (IL or WI), you could still get the Utah permit.

    I think this still helps the people that can't get permits from their home states, but if you can get one, and your state recognizes Utah's, you have to do that first.

    Here's an excerpt from the Salt Lake Tribune that backs up my point:

    "The Legislature gave final approval Monday to a bill that would require out-of-state gun owners who seek a Utah concealed-weapon permit to first obtain a permit from their home states, if available.

    The Senate voted 25-0 to accept earlier House amendments to SB36 and sent it to Gov. Gary Herbert. The House changes make it clear that out-of-state residents could apply immediately for a Utah permit if their home state does not recognize Utah’s......"
