    To All,

I need to cover a topic for my Human Resources class and was hoping to exploit some knowledge and wisdom gained here.

Does anyone have any experience working for a company where Past & Prior Practices became an issue?

I would like to chat about what side of the fence you were on, employee or management, what the specific issue was, and how it was resolved.

I would love to hear from any attorneys who have had experience with this issue.

Feel free to post or PM me regarding this.

For those who are unfamiliar with what Past & Prior practices are, it is basically the concept that IF a company has provided a benefit that is not part of the employment contract then that benefit can become an obligation of the employer to provide. Example: every year for the past 20 years the company has given away a turkey for Thanksgiving to each employee. This year the company (for whatever reason) decides "no turkey." The union and/or employees can file a complaint w/ the NLRB to force the company to supply a turkey because it has become, through "Past & Prior Practices," an employee benefit. The company can loose the fight and be forced to supply everyone with a turkey.

Thanks in advance for the help.

    Regards,

    Doug
