Lemonade stand question

I know the law in Indianapolis says you have to have a permit to have a lemonade stand.

Now my question is, if a lemonade stand is set up and it is given away instead of sold, would permit be required?

I might add, donations would be accepted but not necessary

I'm not planning one, MdA moms are having one on the circle tomorrow to pass their views off as they "give" lemonade away. I just want to make sure they are legal
