yes that's me...we have 80% of the story done.

My apologies for not recognizing your familiar name sir.

Thank you SO MUCH for exposing this years and years old IMPD problem that basically amounts to theft of recovered firearms, from the rightful owners.

As a life long Hoosier, this flawed IMPD policy weighs on how often or wether I make trips to our capital.

I had a self defense situation in 2018 where I unfortunately had to use my firearm to defend my life and property selling an Xbox on FB marketplace.

I was cleared of any wrong doing and those involved have been sentenced. The case is now closed.

I've tried several times to retrieve my MP SW 9mm from the City County Building Firearms processing Dept on the First Floor East Wing.

I have filled out a form basically detailing a description of the item etc the case number and proof the case was closed etc.
I was told my form would be processed and the prosecutor would need to clear it before My ammo magazines and handgun were released from evidence to me.
This was in late 2020 when the case closed.
I talked to the prosecutor shortly after as he called me about the case and I brought up when I'd be able to get it back and he told me as soon as he gets the form he would clear it.

It's now 2023 and I've yet to hear back from the city County building and the prosecutor.
I have no felonys or misdemeanors.
It's always some ordeal when I go down there.
"You just have to wait till we receive the form back" or "We don't have any updates in our system".

Am I going to need to apply some pressure with an attorney to get my gun back?
I've only had a firearm in evidence one other time and that was with a smaller county and I got it back literally same day. But that was probably because it's a small town and they called the prosecutor directly.
Good morning, I'm a reporter working on this issue. I would like to talk to you if you have time

Good morning, I'm a reporter and gun owner. I have heard from a couple people struggling to get IMPD property room to return firearms. We are working on a story that will air next week, if you are having a similar issue please contact me.
I’m calling bs!!! Everyone know that the media are socialist liberal gun haters!!!

Actually i worked for a newspaper (in the press room) and it seamed that production and administration were pro gun people, and editorial was anti gun!, but thank you for doing a report on this, hopefully the media coverage will highlight the problems that legal law abiding gun owners have to go through to get their property back!

I hope the OP reaches our to Mr. Essex. The story told by the OP seemed to have the right tone and tenor. It closely matches other tales told here re: IMPD property room writ large not following through with appropriate and legal obligations to return property to its rightful owner. Hopefully Mr. Essex can give us a heads up when his report will be aired.

Unless they have a way to communicate back and forth outside of INGO, neither have enough posts to use the PM/Conversation feature here.

Someone wishing to talk to him can send Mr Essex their email address or phone number to him in a PM and he can respond that way.

Low timers can GET PMs, they just cant SEND them. (unless something has changed)

I'll be interested in the article.

I still think requiring a 'ballistics' check on a gun that is not evidence is a 4th amendment violation.

If someone gets their car bumped in a parking lot, are we keeping the car for a year to run tire print checks?
Well maybe, if they find a body with tire tracks across its butt in the parking lot.

I wonder if the items stored by IMPD is insured. What if the items were stolen, destroyed via fire or natural disaster, would they be replaced or the value of said items paid out to the rightful owners? In this case it is guns. Is the room climate controlled? Free of pests and moisture? How long exactly will they store the weapons before disposing of them? The OP complained of a gun being held for five years; three of which IMPD had no more rightful claim for withholding. What if he gets his gun back but with rust, pitting or other damage? The fact this story was already in the works suggest there are many more citizens affected than what we read of here on INGO. I look forward to Mr. Essex's workpiece.
