Question for INGO's legal experts, both the arm chair ones and the real ones:

While visiting a loved one in rehab in a skilled care facility, a lawful, licensed individual, that is carrying concealed gets confronted by the sign pictured. There is another sign in the lobby that states 'carry permits are not recognized on this property'.

I do not believe that there is a daycare or school within the property.

My understanding is that the sign does not carry the weight of the law and that: A) As long as the staff has no idea the person in question is carrying(i.e. well concealed), there is no harm/no foul. B) And if it were discovered that the person in question was carrying a firearm, the establishment can ask them to leave and trespass them if they do not comply when asked to leave.

Of course, I'm asking for a ... um ... friend. Thanks in advance!

My take: The sign that is enforceable by law, says so. That is an indicator to me. You did your due diligence to clear there is no school or daycare on premises. Make the decision that reflects your priorities.

There are a lot of reasons a private establishment can ask you to leave. If I'm asked to leave a private establishment, regardless of the reason, I do.
If a stranger asks me if I'm carrying a gun, I ignore them, but I might reply with "would you like me leave?" depending on where I am.

    IMHO:

    1) They appear to be stating specific reasons why they may ask you to leave. I am sure they have more, but they felt those important enough to make stickers.
    2) I don't have a "carry permit" for them to recognize, so a moot point.

Ah…an asc building! As others have said, you can be “trespassed” and told not to return…if you get caught carrying, my advice, either don’t get caught, or don’t carry, I’ve been with my wife for 10 years, and all of those she’s worked in a nursing home/rehab facility, and every one has had a no weapon policy…and every time I’ve gone to one she’s worked at, I didn’t carry a weapon…that they know of! (Yes one was an asc company!)

Just last weekend I moved some stuff to her new office, I was there for an hour bringing in things from the car, moving furniture, talking to the other employees…and they didn’t “no” I had a 9mm in my waistband (I’m really starting to like appendix carry!)

The resident you are visiting may have more permanent issues based on the contract they or their family signed.

Agree with above, the sign itself carries no weight of law but if asked to leave for carrying can be charged with trespassing if refuse to comply.
There are only a few places illegal by rule of Indiana law to carry. From memory: The Post Office, A lake under control of US Corp of Engineers, Schools, Churches (if being used as a school). I think that's it.

As above, if they don't want you to carry they can kick you out. But you won't be subject to arrest unless you refuse to comply and are tresspassed.

Keep it covered and keep your mouth shut and you should be ok.

IIRC, one of the legal beagles here said the signage would need to state something to the effect that carrying without permission would make your presence trespassing.

Not always. Ive seen private property signs asked about here in several threads that were either outright lies, a corporate sign on a franchise from another state, or simply incorrect.

    In order:
    1. Just because they SAY its unlawful doesnt make it so. I can post a sign saying its illegal to eat ice cream on my property. Doesnt make it so. I think we even had a sign like this discussed in the past several months.

    2. There is a chain here that their HQ is in a state where the sign carries the weight of the state law where HQ is based. I think it even mentioned that state's code reference. Of course us not being in that state makes it irrelevant. But they dont care and hope that everyone isnt paying attention and THINKS it has the force of law. They just send the signs to each location and tell them to post them.

3.As for the simply incorrect, there are many signs around, especially in parks that were negated by Indiana's preemption law. Those local agencies admit the sign is no longer valid, but havent changed/removed the sign because [insert stupid reason here]. I believe an INGOer questioned one park manager and he said "You are right. Just ignore it." . They hope most people wont know about preemption and will follow it not wanting to get arrested. Which I guess falls under point 1 as well.
