AFAIK deadly force is deadly force. If it's justified, it's justified.Out of curiosity, would the self defense apply had the driver simply plowed his SUV into the thug holding a gun on him and threatening his life?
You can never control for exactly the angle that a prosecutor would try to work, but in the theory of the law the weapon of deadly force is mostly irrelevant. If you are justified in shooting someone, you are generally justified in hitting them with a bat. Vehicles have been used as defensive tools many times. I think it's an issue of collateral risk. If you hit what you're aiming at, you aren't really endangering many people around you.
If you go swerving around full throttle with an SUV on a roadway... Well, it's not hard to imagine what could come of that, unintentionally.

Just a guess, but I’m guessing majority of comments were supporting the SUV driver and calling it a good shoot... and everyone knows yahoo can’t allow that so they shut the comments down.
