    There is right and dead right. Comply and live to fight another day in court or public oppinion.

    SE just keep it light and cordial if you go see the chief.
    If he blows you off then you have to decide how high or loud you want to escalate this since only you will face the backlash or rewards for taking a stand.

    I am glad you posted your experience. While I know it was no fun the point here is you handled the situation with some good sound common sense. What everyone needs to understand is the outcome of most all LE interactions is dependent on how one acts. The LEO did not know what you was up too and he did not know your intentions. Some officers would have handled your situation a little bit different. It all depends on their individual past experiences,training,confidence level and their gut feeling with a given situation.

    What really galls me is what some of these internet commandos come up with. They are the same kind of people who end up getting tased and jailed over a silly traffic ticket. Kind of like this one.

    So let me get this right. Some of you guys out there feel that if someone calls 911 and tells the police some one is breaking into a building and the officer pulls up and finds someone he is breaking their civil rights by point his firearm at them? REALLY????? I think you should thank the officer for his expedious response to a possible burglary in progress. Just my 2 cents.

    Exactly what I have been thinking through all these pages. If this were my property, I can only hope the LEO's act so quickly and efficiently. I guess we should all wear BG or GG hats so the police know who they are dealing with ahead of time or you could just whip out your CCW badge and prove your status as a "proper" person. ;)

    I've been reading this thread all evening and the only part that I see that might've been excessive would've been where the officer kept the gun pointed at the OP's head after he had complied with the officers orders to get down on the ground.:popcorn:

    So what exactly is the criteria for a cop to pull his gun. Clearly it isn't the same as a citizen. It all seems excessive to come up to a guy already drawn, hand on pistola would seem more appropriate, if they believe the guy is just stealing (non violent ofense).

    Can anyone elaborate on what the criteria of acceptibility for a cop to point his gun at someone is?

    if he feels that his life is in danger. an armed suspect will certainly make him feel this way, as in the OP's case. (sorry, but until they vetted you, you were a suspect.)

    I also have had LEO pointing guns at me (as well as tazers) and I about shat myself when I turned around and saw them all standing there. so long as you keep your head and don't do anything stupid, you won't get shot.

    I'm having a really hard time with why the cop had his gun aimed directly at SE. If I found someone on my property, I might have my hand on my firearm. If I saw they were armed (holstered), I'd probably still just have my hand on my firearm. I can see the cop having it drawn, 45 degrees at the ground, index straight out (not on trigger). Just seems like the cop was offering deadly force before it was justified. Good job on identifying as LE before dodging behind cover (whatever was available) and drawing. Hopefully if I ever get drawn on by surprise, that I'm able to identify before reacting to save my own life. If anything, I'd have to say speak to his superior and fine out if pointing a firearm at someone's head is standard procedure. Just seems like a bad idea to me in this instance.

    LOL! This is coming from the guy who posted that he would hit a guy who was fleeing from breaking into cars with his car or break the guys leg if he caught him? I never did see your response to the IC codes I posted on that one.

    I sure hope the cops don't believe in following/knowing the law like you. Calling the cops "cowboys" is a nice kettle/pot meeting unto itself.

    As to SE's experience, the only problem I can see would be the continued pointing of the gun at his head after he is clearly compliant. I wasn't there, but I would think low-ready would be more appropriate under the circumstances.

    I commend SE for dealing with the situation correctly. I understand the reason the officers handled it the way they felt they needed to at the time but there are a couple of things that stick in my craw. I agree that the officer should have gone to low, ready once SE was on the ground... there was little need to keep him painted once he complied with the officer's demands to get on the ground without any overt hostility.

    The thing that I have a hard time getting my head around is that I, personally, would be hesitant to get face down into the mud. I am not so fussy as to getting dirty but I could easily see, depending on the situation, this affecting the rest of my day due to a misunderstanding. That is not the time to try to bargain and negotiate with the officer but I would be hard-pressed to screw up whatever plans I might have for the day by having to go change out of muddy clothes because I had no opportunity to ask the officer for some consideration. Granted, I have the the luxury of knowing that this is a misunderstanding that will be ironed out shortly and easily and at the time the officer does not know that but I think I may be tempted to ask the officer if I can wipe my hands off on his uniform when we are all done so that we leave somewhat on equal footing.

    I have no problem with being treated as a suspect, I do have a problem being treated as a criminal. I ask the officers that are members here, "what is the best way to request some consideration?" I have no problem with complying with reasonable requests, I just do not want to have to wear it the rest of the day.

    Sounds like a heck of a crazy day SE! I"m glad you're ok and everything worked out well. I know what its like to have cops mistakenly on you, and its definitely no fun....

    All in all, sounds like everyone handled themselves appropriately and in a gentlemanly fashion. They should be commended for their professionalism. I too am happy to hear LEO's are welcoming lawful gun owners carrying.:rockwoot:

    Wow guys, really, I appreciate all the comments on the situation. I'm glad this hasn't escalated into a full out cop-bashing fest. I'd really rather this thread not get locked. :):

    Either way, I decided last night that for sure, there will be no formal complaints, just a couple questions to the supervisor and hopefully a couple answers. If it gets brushed off as just another whiny citizen, :dunno: Oh well I guess. Either way, I do want to ask one thing. Is it policy or proper procedure to keep a suspect at gun point like I was even after I'm down on the ground complying 110% with the officer. That's my biggest question, and really my only question.

    Either way, as I've said, I understand why the LEO's did as they did and I'm pretty sure if there hadn't been a fence the gun would have been off me immediately following my "hit the dirt" maneuver. :):
