Ramos cautioned that the collection did not necessarily mean authorities had a DNA profile of the suspect.

Many on this site will say "ho-hum" but I believe this is tyranny in the face of safety...again...SO....why was the DNA of students collected? If they don't "necessarily" have the DNA profile of the suspect(s)?

"I think the answer is, kids can consent, and if they consented and it was knowing and intelligent, [law enforcement] can do the search," he told the Sacramento Bee.

How can a 13 year old know all the implications of a consent? Most adults don't even know...I consider my self to be of average education and knowledge and I would be reluctant to consent tp an interview in a murder investigation.

What else can minors consent to besides murder investigations, birth control, and abortions in California?

And, if any of THIS DNA is EVER used to link ANY of these kids to ANY crime...

Then any defense attorney worth the moniker will have an almost slam-dunk argument to get that particular evidence thrown out.

In fact, the ACLU should be on this case like white on rice.

ACLU - despite their Communist origins - they're not all bad.

    "They're aren't interrogations, they're interviews."

So that makes it all better then...

We won't call them illegal searches anymore, we'll call them Searches for Officer Safety.

We won't call it Breaking and Entering, we'll call it "Oops, address on warrant was wrong."

Between black boxes in cars, regulating snow flakes on mountain tops, and making it so that those illegal high capacity magazines are off the streets, the USA is certainly going to hell in a handbasket.

I think the guy from Lifestyles of the Rich and Famous (Robin Leach) has it right the other night.

"What is level the playing field? It's a colloquial, warm, fuzzy expression that means I am a socialist."

They HAD to do it without a parent or lawyer present, his DNA might have left his body. Beside, a lawyer would have just told the kid to keep his mouth shut.

Think of all the "other" children, for goodness sake!!!

This is all true. Further how many 13 year old kids, even if they have an idea of the implications, which they probably don't, are going to have the fortitude to tell a cop to go pound sand? In most all cases, the intimidation is complete before the first word is spoken.

Not many adults will do it either.

Time to release everyone in Cali who was convicted of statutory rape where the minor consented. Obviously a child can consent and therefore it wasn't rape. (I'm not sure where the purple goes anymore)
