not against state law. Has a no weapons sign. Can you be trespassing if you have to show up for a traffic violation?

The local political subdivisions are ALLOWED by law to restrict weapons in court, it is not against the law.

    No signs/metal detectors no problem.

(I would CC if you are not sure how it would be taken)

If you read the new pre-emption law that went into effect in July, you'll see that it specifically allows cities/counties/etc. the ability to make a local ordinance or court rule that prohibits guns in courthouses.

That said, it is no automatically & always against the law to carry in a courthouse. The local political subdivision still has to pass an ordinance or the presiding judge still has to make a rule to ban guns in the courthouse. If that doesn't happen, there is nothing else that makes it illegal.

But have yet to find an actual law pertaining to this.

Here is the state law that allows it:

    Indiana Code 35-47-11.1

    See specifically IC 35-47-11.1-4(5):

    (5) The enactment or enforcement of a provision prohibiting or restricting the possession of a firearm in any building that contains the courtroom of a circuit, superior, city, town, or small claims court. However, if a portion of the building is occupied by a residential tenant or private business, any provision restricting or prohibiting the possession of a firearm does not apply to the portion of the building that is occupied by the residential tenant or private business, or to common areas of the building used by a residential tenant or private business.

Since it isn't against state law you'll have to find out if it is against your local laws.

Also, not to confuse the issue but the local laws have nothing to do with a metal detector being installed. Even if there is none there it could still be illegal. I wouldn't count on a lack of one, or even a sign, to assume that it's OK to carry there.

Don't do it. I don't know about Criminal Trespass but definitely contempt of court and an ordinance violation.

Did you check the county website?

FYI, check your pocket knife too. 2.5" is max. The deputies may let you put it back in the car or they may take it and give you a ticket.

Just to expand on what Kirk said.
The way it was explained to me is you won't find courthouses in the IC becuase the courthouses belong to the judicary part of government and the legislation portion of our government can NOT write laws for them since those are in the control of the judical branch.

Now that being said the judical branch has "court house rules" and if you dis-obey those you can be found in contempt of court (which is FAR worse than breaking any law) since the judge can toss you in jail until he feels like it.

The indiana supreme court makes the "house rules" for all the courts in Indiana and their standing order is every court makes their own rules.

So you have to go and read the house rules for your courthouse to see what they are. Some courts allow firearms, most do not.
