    My employer announced this morning that the COVID-19 vaccine will be required for employees beginning Aug 15th.

    Any of you legal types have thoughts on whether there's any basis for legal action?

    Any adverse reaction is an OSHA recordable and work comp claim if the vaccine is mandatory.

    “If you require your employees to be vaccinated as a condition of employment (i.e., for work-related reasons), then any adverse reaction to the COVID-19 vaccine is work-related. The adverse reaction is recordable if it is a new case under 29 CFR 1904.6 and meets one or more of the general recording criteria in 29 CFR 1904.7.”

    Yes, they can take legal action if you refuse (eg: termination).

    Yes, you may be able to take legal action if they enforce (under ADA or Title VII).

    Of course, contract employees may have specific terms (agree to by both parties) that go beyond general legal guidance.

    Depends on how against the vaccine you are then. If your worried about being up a creek without a paddle if something goes wrong the osha thing clearly makes it your employers responsibility if you have a reaction.

    if your fighting against it for other reasons then it may be time to get a lawyer.

    Isnt indiana a at will state? National news last night talked about this issue. No federal law prohibiting employer from requiring vaccine. Some exemption but not much. Maybe its against your religion. Then youre ok.

    I find it amusing that people are getting out in front and wondering about suing for reactions.

    You are correct, Indiana is an at will state, unless you are working under a contract.

    SB74 and HB1488. Have already contacted all the authors and co-authors.

    Unfortunately, I otherwise like my job, and what I do is kind of a niche thing. So, changing up would be a pain in the neck, probably require a move, etc. Not a happy camper.
