Read in the Star today the mother Jeremy Atkinson is suing Kroger for $75,000.00 in damages in a wrongful death suit. Convicted felon had an outstanding warrant. They are saying Kroger was negligent by not enforcing their gun policy! Complaint states"Kroger owed Atkinson a duty to exercise reasonable care for his safety, refrain from wantonly or willfully harming Atkinson and/or acting in a way that would increase the peril to Atkinson as a result of being on the premises" WHAT THE HELL???? This dirtbag went there to rob and/or kill! He got what he had coming to him!! What scumbag lawyer took this case? No wonder people hate them! Would this come under tort reform? Can only hope he not only loses this case but his rep and respect-if anybody does anyway!

Yeah, Kroger's duty to exercise reasonable care disappeared the instant that bastard tried to rob the place.

The biggest problem I have with that entire story is that Kroger has a no-gun policy for its employees...

I'd like to see Kroger counter-sue Atkinson's mother on behalf of their employee(s) who were endangered when Atkinson attempted to rob the store. Unfortunately, Kroger will probably settle this out of court and will use it as further justification for leaving its employees vulnerable in the face of violence in their stores.
