    jed, Halbrook still has the D.C. Court of Appeals to address, then possibly en banc and then the Supreme Court has to accept cert.

    So, having the Supreme Court address Heller II is not certain, and 2012 may be optimistic.

    Maybe a Heller 2.0 will come of this. Hopefully Scallia will choose his words better this time and err on the side of liberty and freedom instead of statism and "common sense gun laws".

    Wow, could THAT be taken out of context!

    To answer your question, if the majority of the people want a law and that law is Constitutional, I would say that the elected representatives of the people would be duty- and honor-bound to pass that law.

    That, however, is what *I* would say. Apparently, the Democrats in the House and some majority of the Senate feel that the people (you know, their employers) don't really know what they want nor can they be trusted to make good decisions, and therefore, the elected, who know what's best for us, must keep us safe from ourselves.

    Do pardon, I feel filthy after typing that. I'm going to go take a shower.
