Can you be in possession of a class III item if your name is not on the stamp? Example, father owns but son takes it out shooting without father being there.

Owner of the item (or a Trustee if the item is owned by a Trust) MUST be with the item.

thats the point of a trust. you can put multiple names on the NFA item and don't have to be present with the item.

I kinda figured that was the way it would work. I was thinking about getting a can that both my son and I could play with. Without going thru the expense of a trust.

Trusts don't have to be expensive. Indiana-specific living trust forms from US Legal Forms can be had for under $50.

May not be what you're looking for, but it's an option.
