    Im curious as to how they are going to run FDA trials...

    ****, he didn't die.... so does that mean the drug does, or doesn't work?

    Actually the FDA did approve the use of this drug, it's a barbiturate anesthetic.
    It's used to knock the person out so they don't feel pain from the other injections.

    That and its ::someone:: doing an end-run around the fact that they can't just up and ban the death penalty so they are doing a de-facto ban on it. Same way they couldn't ban NFA weapons but put a 200$ tax on them (back when 200$ was a lot of money)

    What is funny is that they want you to use the more painful methods. There are many drugs that can be used. I guess they want it this way.

    I am of the opinion, "Who cares how they die, they were sentenced to death anyway." I also do not believe they should be allowed to sit on death row for 2-40 years.

    The constitution operates to prevent the gov't from inflicting cruel and unusual punishment on its citizens. So, it is the constitution that cares how they die.

    Indeed, this is a collateral attack on the death penalty, and a creative one at that.

    Prior caselaw says the electric chair, hanging, and firing squad are legitimate alternatives. Perhaps we should go back to that.

    (In reality, the financial burdens of pursuing a capital case are too much for most Indiana counties. The defense bar made sure to see that happen.)

    IMHO, it is unlikely that there will be any new Indiana death penalty cases for a long time to come.

    As for the 2-40 years, the normal appeals procedure for any case take roughly 5-6 years (depending on several factors). Capital cases deserve scrutiny, so it can take about double that (absent any problems).

    I'm against the death penalty, but for firing squads. According to most movies, it's a very cool way to die. Anyone see Breaker Morant?

    I think we should go back to the old hang 'em days, out on the public square. It seemed to be a very popular family event back in the day. All of those young 'uns learned what would happen to them if they become criminals..

    Trees are obstructing the view again.

    All the drugs used have been approved for other interventions, the point is that they haven't been thoroughly tested and approved for this intervention.... The bigger point is the long term out come doesn't matter.... IMMEDIATE DEATH IS THE GOAL AND IT WORKS!

    Kind of like using an alcohol pad to disinfect the site of the IV so the "patient" doesn't get an infection :rolleyes:
