    DELPHI, Ind. – Delphi murder suspect Richard Allen has been ordered to be moved from Westville Correctional Facility to another prison in the state.


    According to court documents, Allen’s next stop is Wabash Valley Correctional Facility in Carlisle, Indiana. That’s in Sullivan County.

    Yes. But we are talking about holding, not a sentence from a state court.
    Yep. And I am pretty sure there are folks serving short stints of state sentences in the Marion County jail. (as well as other municipal jails across the country)

    Its my understanding that not everybody in various detention facilities are there for the prescribed purpose of the building due to convenience. Like "You've been convicted but only have 175 days of your sentence left, all told. Just sit tight. Its not worth the hassle of transferring you to a different facility."

    And I think I heard that is part of Indy's problem. They're selling beds to the state and feds, so that limits how many local criminals we can house. thus leading to the plethora of GPS units out there.

    I think maybe @Simon6101 might have insight into this arena and correct me if I'm wrong. (very possible)

    Marion Co. Does hold some Federal inmates but we hold more waiting on the State to accept thenm than we do feds. State does leave some at the local level depending on the charge and sentence. We also hold quite a few for mental health placement

    In lake co they didn't have a space problem, if they ran low on beds they would just move in a few more trailers. That was before they built a new much larger jail. The work release both local and state were in the old TB sanitarium across the street from the county complex. Local was one floor, state another, and the third was pretty much unused. They filmed scenes for some movie there, the operating room still had the original equipment from when it was shut down in the mid 70s.

    It was surprising to me how many counties bought/sold beds to each other. White co holds inmates from several nearby counties including Carroll. Carroll only has a dz-15 beds, they buy beds from something like 3 or 4 or so other counties. It was one of the biggest selling points when they were trying to get funding to build a new jail, instead of spending whatever ungodly sum that they were they would save that and make money from selling excess beds.

    The order from the IN Sup. Ct. on the confidential records issue. Long story short, the Court/Judge won. One part of that (but not the only part) was that the Court had already ordered almost all documents to filed in the public docket.

    On the reinstatement of defense counsel issue, the IN Sup. Ct. has set oral argument for January 18th. That's fast. I have a preexisting case that is set for argument on the 25th. Also, they set the length of argument for 60 minutes. The standard IN Sup. Ct. argument is 40 minutes as was the one I did a few weeks ago and the one set for the 25th.

    I can't read anything into what the court may be thinking. "Original Actions" which this was brought under are very rare to begin with and are normally dealt with in an expedited manner. Also, criminal cases have that whole constitutional right to a speedy trial thing, so courts get to those cases faster. As to the length, I guess they think there is something to talk about. In an "Original Action" there is less of a trial court record and no court of appeals record to look at, so maybe they give longer arguments. Don't know.

    I do hope this doesn't devolve into a circus. It feels like it's devolving into a circus.

    Rolling up on 7 years... if digging up John Dillinger would keep the media circus on West 38th Street and this trial could proceed in a non-circus manner? I say dig him up.
