    Nope, different parcel, different county.
    The first property we looked at the realtor never got back after an offer was tendered.
    Even attempted to contact them after some time to consider the offer.
    Realtor wouldn't answer the phone for more than a week after offer was tendered so uncle rescinded the offer on that property.

    The property we're talking about now is roughly 55 acres.

    That is big enough to stay away from the neighbor unless you need to be over there.
    Get the land. Survey it and mark it. Put up a fence right down the line just barely missing his intrusion.
    Heck if hr is a complete butt head build a shed over his well head. Maybe an out house.

    The neighbor has voiced concerns that he "doesn't want anyone building close to his house", but then tells me that there is no electrical service available to this lot. It sits between two power company boundaries, but has never had service run to the property.
    He also told me he didn't want anyone hunting close to his house, even though it sits partially on property that does not belong to him.

    He tells me that his grandson hunts HIS property, and he doesn't want that upset...

    It seems to me that the guy has been using the property in question for years and doesn't want to give it up.

    Just because. His rights end when they cross into yours.
    But you may be correct.

    Part of me is with CM on this, nothing says you can't store barrels of pig manure right next to the well if he wants to make a stink over this. Best bet is to walk away from the deal.

    FWIW, Indiana has statutes regarding well contamination. If you apply something to your property and contaminate a well on or off your property the penalties are the same and they are VERY heavy penalties. I wouldn't go there...

    I could be a butt head too.
    The neighbor told me that "his" well ran dry a couple of years ago, so he went out and installed a "catch basin" to direct the water into his "well".
    I asked him how deep his well is and he told me "15 feet!"
    He doesn't really have a well per se. He has a glorified cistern that he is directing runoff into, then pumping it out to service his house.
    The realtor told me the health department would probably shut his "well" down.

    I would rather not get into a back-and-forth with this guy.
    I have enough headaches in my life right now without him.

    Skimmed the thread. If your uncle is serious about this parcel, he needs to talk to a lawyer. Probably good to talk to 2 lawyers: one from the area and one not from the area.

    This is a complicated area of real property law.

    Yeah life's plate is pretty full.
    He might get someone for a neighbor that unlike you would put him through the wringer. You can only hope.
    15' is not a well.

    Bingo. We have a winner. 55 acres is enough to give up 100'. Adjust the price and move on if you want it.

    If that were going to be the end of it I might consider this, but I don't think it will.
    This property is an hour away from my house, so I would have no way to keep track of who is using the property for whatever reasons they choose.
    I also have the feeling that the neighbors grandson also hunts the property in question and doesn't want to lose it.

    Now, I have not mentioned yet, but this property is being considered strictly as hunting property.
    We have no plans to build anything outside of possibly a small overnight cabin. Something we could go to on a Friday night and spend all weekend hunting.

    I don't want property that I have to share with squatters.

    I love the comments on news articles about this footage. Lib's are all "omg he shot him so many times, after the first few shots it's attempted murder!!" as the Libs are blindly ignoring the old SOB on the ground firing shots from his revolver at the fireman whom acted in self defense. I can't believe people are so stupid.

    Not worth it. take your pick from some other allotment of the 5,506,850* other acres in the state to buy.

    *(total acreage /2 to account for the half of the state you are in and another /2 to account for lots more land you cant possibly have. And -55 just because you dont want THAT parcel. :laugh:)

    This. I won't give legal advice on something i haven't studied since the bar exam (and it wasn't on it). All I know is that a friend of mine who did this kind of law dealt with more contentious and meanspirited disputes than I ever have as a malpractice lawyer.

    If you buy a property knowing full-well the adjacent property owner is, and intends to continue to be a major jerk, at least you'll know who got you into that mess. :dunno:
