Guys - ignore the media sensationalism regarding criminal charges. This story slowed faster than the media outlets wanted for their profit cycle, so they have been pushing "Stewart may yet face criminal charge" headlines to get you to click. They make money each and every time you do so.

Stewart will not be charged and everyone involved already knows it. Civil litigation? That's an entirely different matter.

If the kid had made in unscathed, I still think he should have been booted out of every racing circuit for pulling a stunt like that.

Having raced at some of the "Rougher" tracks in the state we have had a few dust ups in the pits. Even contact on the track never led to getting out and trying to get at another driver.
This is not the actions of a "Great kid" or a sane thinking individual.
I hope the media and the family just shuts up. Family needs to grieve. Revenge is not part of that process.

Wow, I could tell he had gotten stupid close to Stewart's car in the first video, this is proof that you play stupid games, you win stupid prizes.

I know civil suits are not "reasonable" at all, but there is some serious mental gymnastics going on if someone can hold TS responsible for Ward's death.

That video with the arrows shows pretty clearly that the only reason Tony made contact was because the kid went after him. Good for Tony. Bad for Ward.

Even with the video, if Ward's survivors were to throw a wrongful death out there, it would probably be quietly settled with no admission of fault. The cost of litigation and the monetary exposure involved, regardless of the merits of the case, would make a payoff the much more economically sound route than trial.

Not saying its right, cause it isn't; but it is the unfortunate reality.

The slow motion video brings a few things to my attention.

    1. Does not appear Tony turned his front wheels at all, I think he gunned it just get past the angry Ward.
    2. Looks like Ward does grab the wing and hang on, which would explain why Tony's car drifted right up the track, it had around 180#'s hanging on that side.
    3. It does not look like Tony ever ran over Ward, at least I don't see Tony's car lift at all like I would expect if he ran over Ward. Its very possible that falling off the car at 40MPH was enough impact to take his life when he slammed the ground.

Civil litigation has been my world for the past 20 or so years. There is indeed nothing "reasonable" at all regarding the practice of identifying a target and bleeding him of every dime he has (solely because he has the dime to be bled.) Stewart has wealth and the vulture attorneys have an avenue available to them to get their hands on it. That's what guarantees that civil litigation is pending soon.

IF Ward's survivors can be induced to do it. I hope they are better than that.

Kevin Ward?s father rips Tony Stewart for dirt-track accident that killed his son - NY Daily News
Kevin Ward Jr.'s father speaks about deadly accident - 13 WTHR Indianapolis

"I think the reason he probably got out of that car is who put him into the wall. He was definitely put into the wall. Tony Stewart was the best damn driver by far on the track that night. Why he had to go up as high as he did and hog my son, there's no reason for it."

Kevin Ward talked about Stewart hitting his son on the track.

"Apparently, Tony Stewart was the only one driving out there who didn't see him," said Ward. "The one person that knows what happened that night is possibly facing 10 years in prison. Is he going to say what he done?"

I can understand a father's anger, sadness, and pain; and the need to lash out even if he knows deep down his son got himself killed.

I'll not judge him for it at this point.

Agreed +1. He's at step one in the grieving process. It's going to take a while. I only wish there was some way to keep the bottom feeding lawyers at bay until his mind clears and he can think rationally.
