    So local paper article quotes the TTPD chief as saying Daniels was indeed searched when he was arrested. Still won't say where the gun came from.

    There's no "good" scenario here, but given the non-specific statements early on, I became suspicious. We'll see. I still don't have a position on this, just questions.

    ...As a nit picker of the highest magnitude, I will note that "the officer's pistol was in his holster" is not the same as "the suspect brought his own gun with him". Probably, but not necessarily.

    Seems legit. Still waiting for confirmation it was the killer's gun to begin with and not poor weapon security at the dept.

    In summary (all allegedly):

    - Daniels stole gun from a Lubbock home on Sunday and made a "specific threat" to the family
    - Police stopped Daniels because his vehicle matched the description, but let him go because they did not have enough evidence for a search or arrest
    - Daniels arrived back at his room later that night after the campus police initiated a welfare check based upon reports of a student acting erratically and possibly having a gun
    - He was taken into custody at that time
    - He was searched "during his time in custody, but unfortunately he was able to gain access to a weapon"

    Anyone think that last line is oddly worded? Did the find the gun and not secure it?

    - The school's counseling center had called campus police to report that his family had called to say they were concerned he may have a weapon and had been making comments about suicide
    - A Texas Tech spokesman stated that a police gun was not used in the shooting.

    Maybe its nothing, but it seems like something isn't being said.

    So, an update:

    This article New document: Texas Tech student used weapon hidden in pants to kill officer | Lubbock Online | Lubbock Avalanche-Journal says the DA is filing for civil forfeiture of the defendant's vehicle. It reports some interesting details are contained in the lawsuit documents:

    - The police do indeed believe he smuggled a gun in his pants into the police station. This seemed obvious, but as Mr. Nitpicker notes above, it wasn't definitively stated. Until now apparently.

    - Some time prior to 0100 defendant was at somebody's home in Lubbock, and then departed. Homeowner discovered his Springfield XD45 missing from nightstand. Someone had noticed defendant in that bedroom but defendant had said he was looking for the bathroom. Homeowner called defendant, who returned to the home and told homeowner if he (defendant) had stolen the gun, he would kill homeowner and then himself. Defendant departed.

    - Lubbock police (not TTU police) stopped defendant in his vehicle in response to homeowner's complaint, but defendant refused to consent to search and officers did not feel they had probable cause for a search. (NOTE: from reading comments elsewhere by various other defendants and their attorneys, this must be the first time in history that a police officer did not smell marijuana in a vehicle that he really wanted to search. Odd thing is, he probably would have found some.)

    - About 0300 defendant's fellow residents at his dorm (NOT family or campus authorities, at least not at first) called police because they heard a gunshot in defendant's room.

    - TTU police conducted a welfare check - nothing in the articles indicates they knew about the alleged handgun theft or the stop by the Lubbock PD. They frisked defendant but apparently found no weapon, and with defendant's consent searched the room, finding marijuana and pills. Defendant arrested, cuffed, and taken to the TTU police station. (Later, after executing a search warrant, they found bullet fragments and a shell casing, but not during the welfare check.     - Defendant was uncuffed during processing, and some officers took the pills to another room to identify them (Xanax IIRC) leaving Officer East alone with defendant. Then a shot was heard, the defendant gone, and officer's body cam (but not pistol) missing. Body cam and a Springfield XD45 were later found on the route between the TTU station and where the defendant was caught.


    Defendant indicted for capital murder of a police officer on 11/1, which in Texas has two possible punishments: life without parole or death.

    - It appears the dorm residents heard the gunshot in defendant's room about 3am on Oct 9, but police did not make a welfare check until later that evening. There's no time given for when the dorm residents called police. ?!

    - Also the family's call to police apparently came after he had already escaped from the TTU police station and called his mom.

    Springfield XD45 on a slim kid in his pants. Worst "search" evar!

    There were two officers, one a patrolman (I guess) and the other a corporal, that went on the welfare check. The patrolman was killed at the station. If the corporal was the one who conducted the search (or if any other officer frisked that kid and missed the gun), I would be horrified to be him. He should probably be on suicide watch. Especially tomorrow.

    Hollis Daniels, 19, was charged with capital murder of a peace officer and is accused of shooting Officer Floyd East Jr., at the university police station in Lubbock. According to court documents obtained by KCBD-TV in Lubbock, a public defender has been appointed to represent Daniels.
    A capital murder charge carries a sentence of life without parole or execution, and documents say prosecutors will push for the death penalty.

    Daniels is to be evaluated for mental competency to stand trial.

    The Texas Tech student arrested in the fatal shooting of a police officer is now being represented by a Houston attorney who handles high-profile cases, court records show.

    Chip Lewis, whose clients have included real estate heir Robert Durst and Enron founder Kenneth Lay, will be representing 19-year-old Hollis Daniels, according to Lubbock County court records.

    I hadn't realized, at age 48, he had only been in LE 5 months.

    His obituaries say he graduated high school in 1989, got an associates in microcomputer technology, then...graduated from El Paso Community College Law Enforcement Training Academyin 2016. Nothing on the in-between period except worked as a security guard right before he became peace officer.

    Update:

    Hollis Daniels appeared in court in November 2019 so the judge could hear a motion by his attorneys to rule the death penalty unconstitutional. The judge ruled against him and he still faces a capital murder charge.

    Hollis's attorney is Chip Lewis from Houston, who is also the defense attorney for Robert Durst who is also facing trial for murder in California. Lewis told the Texas judge that he cannot participate in a murder trial other than Durst's without the permission of the Judge in the Durst trial. Durst's trial started last spring but was postponed indefinitely because of Covid...or more accurately, because of California's response to the Covid problem. The Durst trial is expected to last several months so even if it started in January 2021, Lewis would not be able to represent Hollis until late next year.


    Hollis's trial has also at least partly been delayed by the Texas court system going into trial hibernation, along with the mental evaluations and all the other baggage that goes with a capital trial.


    It seems to me that the answer is that Lewis needs to choose which client he is going to represent, or maybe have that chosen for him. Or maybe everyone is better off if Daniels is just sitting in jail waiting. I dunno, it's been more than three years already.
