He's not a government actor. He didn't deprive anyone of an enumerated federal right. He wasn't on federal property, etc., etc. etc.
... and Trump didn't urinate on Russian prostitutes, and [insert long list of fake or missing justifications for witch hunts here].

Legally, in the factual sense, I see your point and completely agree. In reality, I believe that the only reason they won't go after him another way is that they don't see enough upside in it.

cortez rice is a good example of "stupidity knows no bounds".
I knew that name sounded familiar. He's Saint George's nephew/cousin/friend/who knows? Cross-posting would be in order, can't find the "officer who thought she had a Taser but it was a gun" thread.

Cortez Rice, 32, has been charged with felony harassment with aggravated violations — tampering with a juror or retaliating against a judicial officer, KSTP reported. He was taken into custody in Waukesha County, Wisconsin on Monday. The criminal complaint wasn’t unsealed until Friday.

Rekieta Law talked about this yesterday. Said it’s a sweetheart deal. It’s basically pleading guilty to citation. $2K and it all goes away, even though the guy would probably prevail.
Non-criminal, so an infraction here in IN. Yeah, I'd take that deal.
