Just remember that EO's can easily be undone by the next president. And with a conservative stacked Supreme Court, I can't see anything substantially earth shattering sticking as it will be deemed unconstitutional. That is, unless it deals with importing.

TL;DR Ethics rules say you cant run for office for personal benefit. I'd say a gun control advocate nominated to a gun control position is textbook violation of this.

As much as I would enjoy seeing Kut honor his wager, I am confident of two things.

1). It would mean Liberty has been slaughtered.

2). He would weasle and "rationalize" his wayout of it.
I’ll honor my wager, with the conditions set forth in my post. But, just so you know, the Ghost Gun thing doesn’t come close to meeting that criteria.

I think it's a safe bet that he'll do everything in his power to advance "commonsense" gun safety policy through ATF edict.

Chipman served at ATF for 25 years and now works to advance commonsense gun safety laws.

I'll be waiting for the coming lawsuits and if the outcome is unconstitutional then I'll start to worry. Not much can be done if a authoritarian government wanting to take your firearms or make you a criminal for having them until they actually do, and get by with it via SCOTUS.

Because the two seem to be confused in this thread...and this is going to help Kut's case in this scenario...

It looks to me like some folks here need to learn the difference between executive actions vs executive orders. Obama issued 23 Executive Actions on guns, none of which meant more than the paper I wipe my butt with... The White House keeps saying Executive Actions, not orders. They are telling you that what they are doing is a nothing-burger. He can make whatever wish list he wants, it has no legal power.


Feel free to correct me if I'm wrong but I'm just looking at what they are actually saying...

I thought that the constitution limits the federal government to controlling commerce between the states, not within. So if a company makes firearms and sells them everywhere it can be controlled but if an individual makes it for himself without selling it out of state, the feds shouldnt have anything do say on the matter.
They get around that by saying that the steel "traveled in interstate commerce" to arrive in your hands. Or failing that, they say thatyou buying it locally "impacts interstate commerce" because you didn't have to ship it from elsewhere.

They also seem to like that if you communicated on the internet to make the deal happen, communication is regulated by the FCC, so even if you communicated in-state, the medium you used (internet) is an interstate platform, and thus, they still have a hand in the pie.

Same thing as it is now. You don't need a NICS check to transfer a gun from yourself to yourself. NICS is for sales, not construction.

Like you said, they're idiots. The only thought here was that the morons who don't know what they're talking about are going to see "ghost guns" and "background checks" and think ground was won. It wasn't. This changes nothing. Your "not a firearm" is still not a firearm when you buy it. If you turn it into a firearm, you're a patriotic American practicing your rights. You buy a "ghost gun" from a dealer (which is never gonna happen) and you have a NICS performed just like you would for any other firearm.

Now... This is just the way I'm seeing it right this moment and is about the only way this could be constitutional. The actual wording, how ATF enforces it, and what other EOs may come with it are entirely different topics. We'll find out most of this tomorrow, but I'm betting on a nothing burger. Just like almost all of Obama's EOs.
Why couldn’t the POTUS just tell the ATF to say it’s a firearm, just like they did when they declared that bumpstocks are machine guns? So far the ATF has gotten away with that.

You mean in the same way that the feds who died were connected with Clinton, shot in the back, and Lon Horiuchi just happened to feel the need to have his rifle rebarreled immediately after Waco?
