    I read the .02 and thought the same thing, "how can an OWI be justified?" The level of intoxicant present is not an issue. That is why the officer has the suspect perform a field sobriety test, in front of a camera if they can, to prove that they do not have the capacity to operate a motor vehicle. The standard might be .08, but some people are not capable of safely operating a motor vehicle with much less alcohol on their system. Think of it like this, you may have been driving 25 MPH in a 25 zone, but wrecked the car because of ice or whatever, and then get a citation for driving too fast for conditions. Sure, you were not going faster then allowed, but you were going faster then you should have.

    I have a CDL and if I remember correctly, my blood alcohol limit is .04 even if I am not driving a commercial vehicle. Is that fair? I could probably drive better then a bunch of people with a .12 level compared to some with no alcohol. Rules are rules though. Want to play the game? Play by the rules or be ready to pay the price.

    I am with you about having a separate set of rules compounded with our own subset of law enforcement dedicated to hunting us. That fuels my lack of having a problem with Springstein's charges since he is advocating more of this **** on us.

    The final end result was he only had a BAC of .02. (ish?) FAAAAR below the standard for DWI. But he did end up paying a fine for drinking alcohol in a park, which itself is illegal.

    So no drunk driving, just drinking where its illegal.

    I wonder if the stupid commercials will play again since it was a false alarm. Or are they going to be teetotalers and continue to park the commercial simply because he was caught drinking, even though it wasnt to intoxication?

    Was the BAC at the scene or hours later?
