    I posted this in the legislation thread, but if some of you have not seen it, here is Thomas Massie educating the head of the AFT on the absurdity of this move. At the 1:10 mark, Massie corners Dettelbach on the original SB Brace and it's separation from the buffer tube.

    Well stated Mr. Massie...the ATF does not have the legal authority to do what they did!

    Talking to my lawyer the issue is you cant form a trust to put these in after January. So if you waited to see what was guna happen then your SOL. Essentially these guns die with you.
    You can register them individually then transfer them to the trust on a form 4 later. Not totally SOL, there are work arounds.

    Ill check with my guy but it definitely read like that wasn't an option. Of course he hasn't sat down with the ATF so its possible you have info he doesn't.

    Theres no way to transfer it and it gets surrendered to the government who will destroy it because it holds no historical value.

    This discussion will all be moot when this unconstitutional "law" is struck down.
    That is correct sir in that this rewriting of a regulation is not a constitutionally based 'law'...as a legally enforceable law would be. With a Constitutional-based, or legally enforceable law, the 'change' would have been introduced in the House as a bill, passed through and approved by the Senate, and then signed into law by a President.

    the courts should strike it down as trash. If the ATF can't read or understand the law before approving somehting for 10 years, then it is now "in common use" and should remain in common use. Further, ALL SBR should be removed from NFA since they made such a stupid over reach.

    This thing sure is a pain in the butt. I got my forms submitted. What really perplexes me about this ruling was that I don't see the point at which it accomplishes anything? So, we are being told that there are between 10 and 40 million braces in circulation. With this ruling, law abiding citizens, like myself will register or be compliant, but what percentage of criminals will do so? Is this really going to take the braced pistols out of criminals hands? How often is anything actually done about handguns with Glock switches or full auto conversions when they are found illegally? I suppose it will prevent new purchases, but if 99% of braces get registered, that still leaves hundreds of thousands in circulation which are unregistered right?

    It has nothing to do with keeping them out of the hands of criminals.
