I just hope they don't do something stupid, like change their mind about what constitutes pinning and welding a muzzle device onto a 14.5 barrel.

I never made the pistol brace plunge, but I did buy a premade 14.5 BCM upper with a pinned and welded extended A2 hider.

No reason why they couldn’t do something like that. I’m sure that was just an oversight this time around. Just wait until all the long muzzle devices meant to make those evil braced pistols hit the market.

The BATF&E knows their website can not manage to process all of the incoming forms, i.e. the site will crash leading to delays in submission which, nonetheless, will not put the 120 day deadline on hold. Further I assume in the small print you will see that you are not really registered until you receive your tax free tax stamp. The BATF&E knows full well they can not process all of these forms in a timely fashion therefore anyone registering will now have a firearm in limbo
until the stamp is issued... years will pass before all of these forms can be processed.

Bottom line, this is a very disingenuous plan to get these firearms/owners emasculated. C'mon, the BATF&E "giving" some leeway? Don't count on it.

So, can I just buy a 16" upper and swap it out with the 8" upper? If so, should I switch the brace to a stock?

They're playing with ex-post facto rule making.

Which means it's likely they will issue a clarification before long that a braced pistol will always be a braced pistol, regardless how you modify it.

So... we are basically in a spot where:

    • People thought they were complying with the law. They thought this because the Gov't told them so.
    • Now the Gov't is telling them that they are committing a felony, and can go to jail or be financially ruined.
    • People are scared that "The Man" will come for them in the middle of the night if they don't comply.
    • People are scared that if they DO comply, "The Man" will come for them in the middle of the night.
    • Peoples fear is not unreasonable, and based on the past behavior of the ATF, FBI, and so on.
    • Confusion multiplies fear beyond the reasonable levels.
Since a brace doesn't make a pistol more dangerous to the public, 'Public Safety' is not the motive. Since the Fed's are refusing to enforce the law in numerous other areas, 'Sense of Duty' isn't the motive.

Seems to me that the outcome is a bunch of scared, confused, people with guns. Seems like the observed outcome is most likely to be the intended outcome.

I just hope they all keep their muzzles pointed in the proper direction while this gets sorted out.
This is why I believe in evil incarnate. Stupidity compounded by ineptitude piled upon by misunderstanding and confusion.

It doesn't serve the purposes of We the People, it doesn't serve the power of the government in any satisfying manner and it doesn't do anything to resolve any conditional problem of the present or future.

All it does is makes things worse for everybody. Tell me evil isn't real.

The AFT has recreated the old Snakes and Ladders game complete with dice. Roll the die, hit the right number(s) and you get a ladder straight to the Legal Pistol Promised Land. Hit the wrong one(s) and you get bit by a snake and go straight to SBR Federal Penitentiary, after being arrested by Special Agent Richard Beazit and his effervescent assistant, "Skiddly-Do" Sebastian, who has secretly guaranteed Agent Beazit, in return for a promised promotion, that the dice are loaded and every evaluation of a braced pistol, without exception, will declare it an NFA SBR. Happy dice rolling folks. AFT wishes you good luck and thanks you for playing! AFT Special Agent Beazit looks forward to shooting your dog during the SWAT siege on your home.

So if it's not published to the Federal Register, no one can bring a lawsuit?

And with it pending, very few are buying / selling / trading them while a select few are registering them.

Am I understanding this correctly? If so, why the hell would they publish it to the Federal Register?
Correct. It’s only a rule when it’s literally on the books.

I suspect they have asked them to defer publishing until the website is updated and ready to accept the “free” stamps.

They are usurping our rights, evidenced by the lack of buying, selling, and trading, without even publishing it. We all know the goal is to disrupt gun ownership and they are doing just that without publishing it. The question in the post you quoted was asking why they would ever publish it if they can achieve some of the results they desire without those pesky lawsuits and court rulings…

If I read correctly INGO took down the ads offering to sell.
