Oh I think restocking fees are all BS anyhow, no matter who does it.I can kinda see charging for the NICS check because I bet a lot of people do think that today is the day they won't get caught, but charging a customer for being a customer seems a step beyond. I worked retail for a long time and heaps of people will tire kick forever without buying anything. Anyone who has ever sold on Craigslist knows that. It's just part of the game.
Anyhow... Crazy stuff.

Unless you blatantly lie on it you might get knock at the door.This seems to come up every few months and it seems the vast majority of guys we rarely hear from again. That leads me to believe that the situation that you believe exists (no charges in your case), is true. If it weren't, it seems most of the guys in similar spots would be back here asking how to fight it. Go buy your firearm. If denied, chase down the issue. No one is going to kick your door in over a failed NICS check.

Does anyone go after said felon or does he walk away free as a bird?Some people know they won’t pass the background check but want to try it anyway and hope for the best. At one shop I worked at we collected the funds for the gun before the 4473 was actually run just to make sure the buyer was serious and if they were denied we could collect the processing fee. A lot of those customers also wanted their money back if they were delayed, but that didn’t fly well either. Most people were understanding about it but there were a few tense interactions when someone was denied. Once a check was run that number was attached to the 4473 and the Feds could inquire about it at any time. The FFL has to keep it on file and can’t just discard it.

They never tell us why the denial was issued. It’s either Proceed, Delay or Deny. We have no police powers so we couldn’t do anything anyway. I’ve had an agent tell me that they do follow up, sometimes, and go knocking on doors of people who lie on the 4473 since that in itself is a felony. I seem to remember a thread about some gun store that not only did that, but also charged a non-refundable re-stocking fee if there was a denial.
The LGS I frequent also has the same policy posted.My local gun shop has a sign up that you will get charged for a denied NICS.
