    Ok, lost me here, how does a state decided to have a state defense force trample states' rights?
    It doesn't.

    I'm just saying the federal government has been overruling the individual States' law for years on both sides of the isle, and so whatever state elects this will just be snowed in by a federal government that will disregard that law.
    Abortion should be decided by the states, but feds have issued a mandate.
    Legal marijuana should be (as is in some states) a state thing, but feds have mandated.
    Gay Marriage should be a state choice....etc
    The fed government is like a black hole that will eventually eat all our individual rights, and eliminate any state government.

    I'm just saying nothing a state does is really going to matter in the eyes of the federal prosecutor.

    So, you are mad at the Supremacy Clause?
    I don't know what that is....not an attorney and I don't even play on on TV...

    I'm not mad about anything, other than a prolonged unabated growth in the power of the federal government. I'm just saying the federal government won't allow any militia statute like this get in the way of enacting a law that bans "assault rifles." IMO of course.

    That was also true of the authors of the Constitution who added the 10A to it

    I would be happy if the right of the people to keep and bear arms wasn't infringed. We wouldn't have these conversations if our rights hadn't been trampled on in the first place. The real question is how do we get our rights back so that we don't have to make new laws to override unconstitutional laws?

    You are absolutely correct.
    I'm confused. If it's a "God given right" then why does it require all the laws and legislature? Why was it that mortal men wrote the 2A, and how could mortal men take it away or alter it? I just find it odd that people mix the ability to defend yourself with religion, because it makes zero sense on so many levels. When firearms and ammo start magically materializing right in front of my eyes then I'll eat my hat. I'm not greedy....I'd settle for steel cased ammo and a no-name AR.

    "Under Article 12, Section 1 of the Constitution of the State of Indiana, the militia consists of all persons who are at least eighteen (18) years of age except those persons who are exempted by the laws of the United States or of Indiana.

    Ind. Code § 10-16-6-1

    "The militia shall be divided into two (2) classes, the sedentary militia and the national guard, as follows:
    (1) The sedentary militia consists of all persons subject to bear arms under the Constitution of the State of Indiana who do not belong to the national guard.
    (2) The national guard consists of those able-bodied citizens between the proper ages as established by this article who may be enrolled, organized, and mustered into the service of the state as provided in this article. The organized militia of the state constitutes and shall be known as the Indiana national guard."

    Ind. Code § 10-16-6-2

    I think that at some point I named myself a Sergeant in the Sedentary Militia, but that seems like too much work. How about a Major? No one really knows what they do.

    "exempted by the laws of the United States" - does this mean Indiana is giving the Federal government the power to exempt everybody and effectively eliminate the sedentary militia?

    "persons subject to bear arms" - what does this mean?
