    This sounds like a 37MM flare launcher that does look a lot like an M203. Is "starburst grenade" what the cool kids call flares?

    As a Walkerton resident, this is pretty close to home. If he really did manage to get his hands on a grenade launcher (m203?) and fire a grenade(news seemed pretty vague on if what ever he fired was legal to own) then he had what was coming to him. The fact that the ATF is investigating means that this guy will more than likely be getting a free stay at club Fed whenever he heals up. Thoughts?
    37mm is legal as are most shots for it. Military uses 40mm

    He is a friend of mine, I wasn't there as I'm working out of town, so I'm not going into details beside the fact I'm not discussing his personal business on the internet.

    ***Legal Note: A 37mm launcher is exempt from NFA laws and tax stamp as long as it is used to launch flares, smoke, or gas. The launching of ANY anti-personnel munitions makes it a Destructive Device and subject to NFA laws and tax stamp.
    ATF has previously held that devices designed for expelling
    tear gas or pyrotechnic signals are not weapons and are exempt from
    the destructive device definition. However, ammunition designed to
    be used against individuals is available for these 37/38 mm
    devices. This "anti-personnel" ammunition consists of cartridges
    containing wood pellets, rubber pellets or balls, and bean bags.


    When a gas/flare gun is possessed with "anti-personnel" type
    ammunition, it clearly becomes an instrument of offensive or
    defensive combat and is capable of use as a weapon. Since these
    gas/flare guns have a bore diameter of greater than one-half inch,
    fire a projectile by the means of an explosive, and, when possessed
    with "anti-personnel" ammunition, are capable of use as weapons,
    the combination of the gas/flare gun and "anti-personnel"
    ammunition is a destructive device as defined in the GCA and NFA.
    As a result, registration as a destructive device is required. Any
    person possessing a gas/flare gun with which "anti-personnel"
    ammunition will be used must register the making of a destructive
    device prior to the acquisition of any "anti-personnel" ammunition.
    In addition, the gas/flare guns are classified as firearms as
    defined by the GCA when possessed with "anti-personnel" type
    ammunition.

    If you ever had one of these launchers without the tax stamp you had better make sure any ammunition purchased for it was not the "anti-personnel" type.

    Let me reclarify my "he had it coming" comment. I'm not saying that he deserved his injuries. I'm just saying that when you choose to launch any type of explosive device from a rail mounted tube of any kind that you are holding mere feet/inches away from your body, you have to be prepared to accept the consequences of what may happen if things go wrong. I wish him a full recovery.

    I've owned a 37mm Launcher (signaling device) and they're pretty safe and fun. I only used breaks (fireworks) and bird bombs but it's going to be interesting to hear what happened and I hope the guy is Ok. As in anything everyone should know that if you use ammo or weapons for anything else than what it's intended for then you put you or anyone else at risk

But, in a month or so, if we find out he had done something stupid like alter the payload, or illegally purchase anti personnel rounds, and gave the media the chance to use the words "grenade launcher" in a factual news story. Even I will say he deserved it.

    This is ALL we need. I can hear that **** sucker, piers morgan now... "BAN AR15, MILITARY STYLE ASSAULT RIFLES, because ANYONE can fire grenades from it, and kill millions of infant children...."

    That's ridiculous to say he had it coming! Do you feel that if you fired a rifle, with unaltered factory rounds, and it exploded and injured you, that you had it coming? Firing a rifle is basically setting off a type of explosive device in a tube that you are holding mere feet/inches from your body. I agree that you have to accept the consequences of of your actions if something goes wrong, but that is far from "he had it coming". I WILL agree that he had it coming, IF it comes out that he had altered the load or something stupid, but to say that he had it coming simply for firing it is quite frankly a little insensitive. As for the comment about us not jumping all over the other guys, the first said to accept responsibility if something does go wrong, which is something i think we can all agree on. The second said, IF he altered the load, or had things illegally, then he had it coming. I think that is also something we can all agree on. Your posts make it seem as though "he had it comming", simply for firing it in the first place. I think that is something we all CAN'T agree on! That's why people probably won't jump all over them too!

    I wish him all the best with his recovery, and hope he is okay.

    sounds like a poorly made round. i know someone with scars on there arms from a bad bird bomb going off in a 37mm. he was lucky but the ar was not.

    My money is on a mortar (big firework) dropped in the bore. Last I heard, flares didn't explode, nor were they called "starburst".
